(A) This Policy

This Policy is issued by POWERMAP TECHNOLOGY LIMITED (“Ampace”, “we”, “us” and “our”) and applies to the data collected by us that relates, directly or indirectly, to you (“Personal Information”) in the course of our business, including through the website and associated services (“Site”, at www.ampacepower.com ) operated by or on behalf of Ampace. This Policy does not apply to any other products, services, websites, features, or content which have their own privacy policies.

This Policy may be amended or updated from time to time to reflect changes in our practices with respect to our processing of Personal Information or changes in applicable law. We encourage you to read this Policy carefully, and to regularly check this page to review any changes we might make in accordance with the terms of this Policy.

(B) How We Collect Your Personal Information

We collect or obtain Personal Information about you from the following sources:

• Personal Information you provided to us: We obtain Personal Information when you choose to provide those information to us (e.g., when you register an account with us; where you contact us via email, or by any other means).

Personal Information automatically collected by us: We collect or obtain Personal Information in the ordinary course of our relationship with you (e.g., when you visit, interact with, or use our Sites).

Personal Information collected from other sources: We collect or obtain Personal Information from third parties who provide it to us (e.g., law enforcement authorities, third-party services (including third-party plugins and cookies) providers, etc.).

Depending on the scope of your interaction with our Site, we process the following categories of Personal Information about you:

Registration Information: name, email address, language preferences.

Contact Details: address (including Zip code), telephone number, country, province.

Purchase Details: records of purchases and prices, consignee name, address, contact telephone number, email address, details of returns, warranty details.

Payment Details: invoice records, payment records, billing address, payment method, cardholder or accountholder name, payment amount, payment date, bank card number.

Information Relating to Our Site: device type, operating system, browser type, browser settings, IP address, referring/exit pages, language settings, dates and times of connecting to the Site, interaction history and other technical communications information (some of which may constitute Personal Information), username, usage data, and aggregate statistical information.

Personal Preferences: personal information related to your purchase and marketing preferences, including browsing history, search history, purchase history, shopping cart purchase history (add-on time, quantity, product), subscription time, order information (traffic source, product, time, cumulative order amount, order status)

Views and opinions: any comments, rating and questions you sent or provided to us.

(C) How We Use Your Personal Information

The purposes for which we process your Personal Information, subject to applicable law, and the legal bases on which we perform such Processing, are as follows:

We have a legitimate interest in carrying out the processing for the purpose of contacting and sending you direct marketing information, subject always to compliance with applicable law (to the extent that such legitimate interest is not overridden by your interests, fundamental rights, or freedoms); or

We have obtained your prior consent to the processing (this legal basis is only used in relation to processing that is entirely voluntary – it is not used for processing that is necessary or obligatory in any way).

Sharing of Personal Information with third parties: sharing of your Personal Information with third parties who provide ecommerce platform service, cloud hosting service, customer service, logistics service, marketing service, data analysis service, payment service, operation service, advertising service, etc.

The processing is necessary in connection with any contract that you have entered into with us, or to take steps prior to entering into a contract with us; or

We have a legitimate interest in carrying out the processing for the purpose of sharing your information with third parties whose platforms or services are integrated with the Site, subject always to compliance with applicable law (to the extent that such legitimate interest is not overridden by your interests, fundamental rights, or freedoms); or

We have obtained your prior consent to the processing (this legal basis is only used in relation to processing that is entirely voluntary – it is not used for processing that is necessary or obligatory in any way).

Management of IT systems: management and operation of our communications, IT and security systems; and audits (including security audits) and monitoring of such systems.

The processing is necessary for compliance with a legal obligation; or

We have a legitimate interest in carrying out the processing for the purpose of managing and maintaining our communications and IT systems (to the extent that such legitimate interest is not overridden by your interests, fundamental rights, or freedoms).

Ensuring Security: identifying and combating technical or security issues (such as technical bugs, spam accounts, and detecting abuse, fraud, and illegal activity).

We have a legitimate interest in carrying out the processing for the purpose of ensuring the security and stability of our Site (to the extent that such legitimate interest is not overridden by your interests, fundamental rights, or freedoms).

Financial management: sales; finance; corporate audit; and vendor management.

We have a legitimate interest in carrying out the processing for the purpose of managing and operating the financial affairs of our business (to the extent that such legitimate interest is not overridden by your interests, fundamental rights, or freedoms).

Surveys: engaging with you for the purposes of obtaining your views on our Site, or our services.

We have a legitimate interest in carrying out the processing for the purpose of conducting surveys, satisfaction reports and market research (to the extent that such legitimate interest is not overridden by your interests, fundamental rights, or freedoms).

Investigations: detecting, investigating, and preventing breaches of policies or terms, and criminal offences, in accordance with applicable law.

The processing is necessary for compliance with a legal obligation; or

We have a legitimate interest in carrying out the processing for the purpose of detecting, and protecting against, breaches of our policies and applicable laws (to the extent that such legitimate interest is not overridden by your interests, fundamental rights, or freedoms).

Legal compliance: compliance with our legal and regulatory obligations under applicable law.

The processing is necessary for compliance with a legal obligation.

Improving our Site: identifying issues with our Site; planning improvements to our Site; and creating new Site or services.

We have a legitimate interest in carrying out the processing for the purpose of improving our Site (to the extent that such legitimate interest is not overridden by your interests, fundamental rights, or freedoms).

Fraud prevention: Detecting, preventing and investigating fraud, and threats or harm.

The processing is necessary for compliance with a legal obligation (especially in respect of applicable employment law); or

We have a legitimate interest in carrying out the processing for the purpose of detecting, and protecting against, fraud (to the extent that such legitimate interest is not overridden by your interests, fundamental rights, or freedoms).

Establishment, exercise and defense of legal claims: management of legal claims; establishment of facts and claims, including collection, review and production of documents, facts, evidence and witness statements; exercise and defense of legal rights and claims, including formal legal proceedings.

The processing is necessary for compliance with a legal obligation; or

We have a legitimate interest in carrying out the Processing for the purpose of establishing, exercising, or defending our legal rights (to the extent that such legitimate interest is not overridden by your interests, fundamental rights, or freedoms); or

The processing is necessary for the establishment, exercise or defense of legal claims.

 

(D) How We Share or Disclose Your Personal Information

We disclose Personal Information to other affiliated entities, for legitimate business purposes and the operation of our Site, in accordance with applicable law. In addition, we disclose Personal Information to:

third-party service providers (such as ecommerce platform service providers, cloud hosting service providers, customer services providers, logistics services, marketing service providers, data analysis service providers, payment service providers, operation service providers, etc.) when we employ other companies to perform functions on our behalf. These third-party service providers may have access to Personal Information if the Personal Information is required for them to perform their functions and the third-party service providers are not allowed use it for other purposes;

• third-party partners, where our Site use third party advertising, plugins or content. If you choose to interact with any such advertising, plugins or content, your Personal Information may be shared with the relevant third-party partners. We recommend that you review that third-party partners’ privacy policies before interacting with its advertising, plugins or content;

legal and regulatory authorities, upon request, or for the purposes of reporting any actual or suspected breach of applicable law or regulation;

accountants, auditors, consultants, lawyers and other outside professional advisors to Ampace, subject to binding contractual obligations of confidentiality;

any relevant party, regulatory body, governmental authority, law enforcement agency or court, to the extent necessary for the establishment, exercise or defense of legal claims;

any relevant party, regulatory body, governmental authority, law enforcement agency or court, for the purposes of prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties; and

any relevant third party acquirer(s) or successor(s) in title, in the event that we sell or transfer all or any relevant portion of our business or assets (including in the event of a reorganization, dissolution or liquidation).

(E) International Transfer of Personal Information

We store the Personal Information described in Section (B) in secure servers located in Canada. 

Because of the international nature of our business, we may provide remote access to your Personal Information to affiliated companies and third-party operation service provider in the People’s Republic of China (only for the purpose of this Policy, excluding the Hong Kong Special Administrative Region, the Macau Special Administrative Region and Taiwan), so they can provide necessary functions. This access is limited, secure and only granted where necessary under strict security controls and authorization approval protocols. 

We may also transfer your Personal Information to third-party service providers and partners as noted in Section (D) above, in connection with the purposes set out in this Policy. For these reasons, we may transfer Personal Information to the United States that may have different laws and data protection compliance requirements to those that apply in the country in which you are located.

If an exemption or derogation applies (e.g., where a transfer is necessary to establish, exercise or defend a legal claim) according to applicable laws, we may rely on that exemption or derogation, as appropriate. Where no exemption or derogation applies, we will take necessary measures to comply with the applicable laws on international transfer of Personal Information, which include without limitation:  

relying on adequacy decisions made by competent authorities;

implementing Standard Contractual Clauses approved by competent authorities to govern the transfer of your Personal Information;

or other means recognized by applicable laws.

(F) How We Protect Your Personal Information

We have implemented appropriate technical and organizational security measures designed to protect your Personal Information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, unauthorized access, and other unlawful or unauthorized forms of processing, in accordance with applicable law.

Because the internet is an open system, the transmission of information via the internet is not completely secure. Although we will implement all reasonable measures to protect your Personal Information, we cannot guarantee the security of your data transmitted to us using the internet – any such transmission is at your own risk, and you are responsible for ensuring that any Personal Information that you send to us are sent securely. 

We take every reasonable step to ensure that:

your Personal Information that we process are accurate and, where necessary, kept up to date; and

any of your Personal Information that we process that are inaccurate (having regard to the purposes for which they are processed) are erased or rectified without delay.

From time to time we may ask you to confirm the accuracy of your Personal Information.

(G) How We Store Your Personal Information

We take every reasonable step to ensure that your Personal Information are only processed for the minimum period necessary for the purposes set out in this Policy. The criteria for determining the duration for which we will retain your Personal Information are as follows:

 

(1) we will retain Personal Information in a form that permits identification only for as long as:

(a) we maintain an ongoing relationship with you (e.g., where you are a user of our Site) or provide services by your requests; or

(b) your Personal Information are reasonably necessary and proportionate in connection with the lawful purposes for which we have a valid legal basis to collect and process such Personal Information,

plus:

(2) the duration of:

(a) any applicable limitation period under applicable law (i.e., any period during which any person could bring a legal claim against us in connection with your Personal Information, or to which your Personal Information are relevant); and

(b) an additional two (2) month period following the end of such applicable limitation period (so that, if a person brings a claim at the end of the limitation period, we are still afforded a reasonable amount of time in which to identify any Personal Information that are relevant to that claim),

and:

(3) in addition, if any relevant legal claims are brought, we continue to process Personal Information for such additional periods as are necessary in connection with that claim.

 

During the periods noted in paragraphs (2)(a) and (2)(b) above, we will restrict our processing of your Personal Information to storage of, and maintaining the security of, those Personal Information, except to the extent that those data need to be reviewed in connection with any legal claim, or any obligation under applicable law.

Once the periods in paragraphs (1), (2) and (3) above, each to the extent applicable, have concluded, we will either:

permanently delete or destroy the relevant Personal Information; or

anonymize the relevant Personal Information.

There may be technical or other operational reasons where we are unable to fully delete or anonymize your Personal Information. Where this is the case, we will take reasonable measures to prevent further processing your Personal Information.

(H) Children’s Privacy

As required by applicable law and our Terms of Service, we consider user under the age of 18 (and a higher age if required by the applicable law in another country) as a child. We do not knowingly collect Personal Information from children. If we learn that Personal Information of a child has been collected without verified prior consent from the child’s parents or guardians, we will attempt to delete relevant Personal Information as soon as possible. If you think that your child provided their Personal Information to us on our Site, we strongly recommend you contact us as described in Section (M) below and we will do our best efforts to promptly remove such information from our records.

 

(I) Your Legal Rights

Subject to applicable law of your jurisdiction, we provide you with the ability to exercise the following controls and choices regarding our collection, use, and sharing of your Personal Information. You may request the following by contacting us as detailed in Section (M) below:

the right not to provide your Personal Information to us (however, please note that we will be unable to provide you with the full benefit of our Site, if you do not provide us with your Personal Information – e.g., we might not be able to process your requests without the necessary details);

the right to request access to, or copies of, your Personal Information, together with information regarding the nature, processing and disclosure of those Personal Information;

the right to request rectification of any inaccuracies in your Personal Information;

the right to delete your Personal Information; or

the right to restrict certain processing of your Personal Information;

the right to object, on grounds relating to your particular situation, to certain processing of your Personal Information where such processing is based on public interest or our legitimate interests;

the right to receiving your Personal Information in a structured, commonly used and machine-readable format and transferring the same to a third party, to the extent applicable;

where we process your Personal Information on the basis of your consent, the right to withdraw that consent (noting that such withdrawal does not affect the lawfulness of any processing performed prior to the date on which we receive notice of such withdrawal, and does not prevent the processing of your Personal Information in reliance upon any other available legal bases); and

the right to lodge complaints regarding the processing of your Personal Information with to the data protection regulator in the United Sates, Japan, the EEA or to other competent authority.

This does not affect your statutory rights.

To exercise one or more of these rights, or to ask a question about these rights or any other provision of this Policy, or about our processing of your Personal Information, please use the contact details provided in Section (M) below. Please note that:

in some cases it will be necessary to provide evidence of your identity before we can give effect to these rights; and

where your request requires the establishment of additional facts (e.g., a determination of whether any processing is non-compliant with applicable law) we will investigate your request reasonably promptly, before deciding what action to take.

 

(J) Direct marketing

We may process your Personal Information to contact you via email, telephone or other communication formats to provide you with news items, promotions, contests, or marketing campaigns and other information regarding our Site that may be of interest to you, subject always to obtaining your prior opt-in consent to the extent required under applicable law.

If you do not want to receive marketing-related materials anymore, you may unsubscribe from our promotional email list at any time by simply clicking on the unsubscribe link included in every promotional electronic communication we send. You may also unsubscribe from future marketing call at any time by making such request during the call. After you unsubscribe, we will not send you further promotional emails or call you, but in some circumstances, we will continue to contact you to the extent necessary for the purposes of providing Site, or other services you have requested.

(K) Cookies and Advertising

When you visit our Site, we will typically place Cookies onto your device, or read Cookies already on your device, subject always to obtaining your consent, where required, in accordance with applicable law. We use Cookies to record information about your device, your browser and, in some cases, your preferences and browsing habits. We process Personal Information through Cookies and similar technologies, in accordance with applicable laws.

Certain Cookies may be stored on your machine by third parties when you use our Site. We have no control over these Cookies or how the third parties use them. These Cookies allow third parties to provide us with a service, for example, analytics about the effectiveness of our marketing activities and user behavior.

Regular Cookies may generally be disabled or removed by tools available as part of most commercial browsers, and in some instances blocked in the future by selecting certain settings. Browsers offer different functionalities and options, so you may need to set them separately. Also, you may be able to exercise specific privacy choices, such as enabling or disabling certain services, by adjusting the permissions in your mobile device or internet browser. You may opt-out of targeted advertising utilizing the Digital Advertising Alliance (“DAA”) AdChoices Program at optout.aboutads.info. In addition, the Network Advertising Initiative (“NAI”) has developed a tool that allows consumers to opt out of certain Tailored Advertising delivered by NAI members’ advertising networks. [The major browsers have attempted to implement the draft “Do Not Track” (“DNT”) standard of the World Wide Web Consortium (“W3C”) in their latest releases. Our Site does recognize browser settings related to privacy, such as DNT And Global Privacy Controls. Further, as] we have implemented site-specific preference settings, via either a cookie preference manager tool which appears as a banner on our homepage, or via your indications of preference noted in the “Exercising Privacy Rights” in Section (L) below.

 

(L) Additional Information for Certain Jurisdictions

Pursuant to certain state laws (for example, California Civil Code Section 1798.100 et. seq) of the United States, if you live in a state with a specific privacy law, you may request certain information about the type of your Personal Information we share with third parties for direct marketing purposes and the identity of any such third party. Once per calendar year, residents of certain states may request this information by contacting us as set forth in the Section (M) below.

 

In addition to the rights set forth in the Section (I) above, these states may provide their residents with the following rights as they relate to Personal Information:

• Right to Know. You may request that Ampace provide you the specific pieces of Personal Information Ampace has about you; categories of Personal Information we have collected about you; categories of sources from which the Personal Information is collected; categories of Personal Information that Ampace disclosed for a business purpose about you; categories of third parties to whom the Personal Information was disclosed for a business purpose; and the business or commercial purpose for collecting or selling Personal Information. Please note that much of the information you can make a request for is already contained in this Policy. Should you wish to exercise this right, please see the Section (M) below which explains how to do so.

Right to Opt-Out. Except via the use of affiliate advertising networks, Ampace does not sell, or share for purposes of cross-contextual behavioral advertising, your Personal Information to third parties for their own marketing purposes. If you would like to opt-out of sharing your Personal Information for cross-contextual behavioral advertising, please use the opt-out mechanisms noted above in Section (K). To opt-out of marketing communications, please contact us as described in Section (J) of this Policy.

Right to Limit the Use or Disclosure of Your Sensitive Personal Information. You have the right to request that we limit our use and disclosure of your sensitive Personal Information to certain purposes permitted by law. However, while the bank card number that we collect, use and disclose may constitute sensitive personal information, we only process such information and disclose it to payment service providers in order to provide necessary services that you request from us.

Designating an Authorized Agent. California law permits California residents to designate an agent to manage their rights under California law. If you would like to designate an agent to manage your privacy preferences, you may do so using the mechanisms noted below under Section (M). We will need sufficient Personal Information about your authorized agent to be able to identify them. As part of this process, you must have permission from your authorized agent to disclose their Personal Information to us for the purpose of acting as your agent.

Non-discrimination. Ampace will not discriminate against you because you exercised any your rights under this title, including, but not limited to denying you access to goods or services; charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; providing a different level or quality of goods or services; suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

Exercising Privacy Rights. If you are a resident of a state with specific privacy laws and would like to exercise any of your rights, you may do so by contacting us via the method described in Section (M). Please provide us with sufficient information that enables us to verify your identity and the rights you have in the data subject to your request. Please note, however, that certain information may be exempt from such requests. Should you want to appeal our decision to decline your request, please contact us as described in Section (M) and indicate your wish to appeal our decision, and the reasons why you believe our explanation of the basis for declining your requests are improper.
